Forest-Fire Enforcement Expands Across Borders to Corporate Groups

Green / Legal: Material follow-up — Singapore NEA's 23 October 2026 notices under section 10 of the Transboundary Haze Pollution Act and Ministry of Law's cross-border investigation announcement

Daily IntELigence Brief | 24 October 2026

Implications: High — Indonesian forestry and plantation groups, their Singapore entities, lenders and investors. Singapore's compulsory information requests now reach corporate groups linked to Indonesian concessions, potentially exposing ownership, supply-chain and fire-control arrangements to cross-border investigation.

Summary: On 23 October, Singapore's National Environment Agency (NEA) served information notices on ten Singapore-registered palm-oil and forestry companies with Indonesian concession interests or related companies holding them. The move extends scrutiny beyond Indonesian concession holders; Singapore's government also announced a specialist panel for cross-border inquiries into corporate structures and supply chains. NEA; Ministry of Law.

Context: The 19 October Daily IntELigence Brief covered Singapore's section 9 preventive notices to three additional Indonesian concession holders, bringing that group to ten, alongside separate Indonesian forest-fire sanctions. Today's new step is section 10 information notices directed at ten Singapore-registered companies and the announced group-level investigation process; the notices are not findings of liability. NEA.

What changed. NEA named Asia Pulp & Paper Company Limited, Asia Pulp & Paper Company (China) Limited, Bumitama Agri Ltd, Golden Agri International Pte Ltd, First Resources Ltd, Indofood Agri Resources Ltd, Kencana Agri Ltd, TSH Global Plantation Pte Ltd, TSH Oversea Pte Ltd and Wilmar International Ltd. Its section 10 notices seek documents on links between Singapore and Indonesian companies, concession locations, and fire-prevention and firefighting measures. NEA separately seeks further documents from the ten Indonesian companies previously sent section 9 preventive notices. The Ministry of Law's 23 October announcement says identified companies will be required to engage experts from a specialist panel to examine operations, corporate relationships and supply chains; relevant agencies and the Attorney-General's Chambers will assess the findings. It gives no deadline for responses or date for the panel's establishment. NEA.

Why it matters. For affected groups, the immediate task is to substantiate concession boundaries, corporate and supplier links, and fire controls across jurisdictions. The planned independent inquiries may add investigation costs and expose gaps that affect lenders' due diligence, transaction terms and investor confidence; enforcement or financing consequences remain contingent on the evidence and subsequent decisions. Market sensitivity was already visible before these evening notices: The Business Times reported that, by the 23 October close, shares of First Resources and Bumitama Agri had fallen more than 14% and about 15%, respectively, since 5 October amid the wider haze scrutiny. Those declines cannot be attributed to the later section 10 notices.

What to watch. NEA's next requests and company responses, formation and scope of the specialist panel, and details Singapore says MAS and NEA will release next week. Watch for investigative findings or formal enforcement decisions before treating any named company's responsibility as established. Ministry of Law; NEA.
