3 September 2020 saw the first PKPU filing against a major Indonesian airline. The case appears to have history, so we are not jumping to conclusions, but we thought it might be an opportunity to comment on the untested interaction between the Cape Town Convention and Indonesia's PKPU regime - and some practical considerations for aircraft lessors (and other creditors with interests in aircraft objects) in Indonesian restructurings.

Regulatory Note: We are sometimes asked to describe our services. We provide strategic advice to companies on transformative situations: from mergers, acquisitions and joint ventures to financing, refinancing and restructuring. This involves creating financial models, analytical reports, presentations and designing and implementing a strategic plan. While we have senior lawyers and accountants on our team, we do not directly provide accounting, tax, securities or (typically) legal advice - we maintain a strong network of leading law firms, accountancy firms, tax advisors and securities firms, and are happy to coordinate a unified strategy and manage the work under a single point of contact. Our legal personnel qualified in New York and England maintain their bar registrations and practising certificates for those occasions where we provide non-reserved legal advice in the course of our activities, and Eliot & Luther (UK) Ltd is registered with the Solicitors Regulation Authority with registered number 836263.
