Attached is a presentation outlining six main approaches that can be taken by Indonesian companies experiencing financial stress - with a view not just to surviving the current economic climate but emerging stronger.

It presents a range of options from the "Ostrich Approach" (doing nothing and hoping things will work out), through Refinancing, Buybacks, Restructuring, Foreign Court Proceedings, PKPU and Bankruptcy - with even the prospect of a Phoenix 'rising from the ashes'!

I give a summary of some of the advantages and disadvantages of each approach and the type of situations where it can be effective. This presentation started off life as a tailored client pitch, but I thought it might be helpful to do a version with more general application. However, the devil is in the detail, so please do get in touch if you would like to discuss a specific situation!

Regulatory Note: We are sometimes asked to describe our services. We provide strategic advice to companies on transformative situations: from mergers, acquisitions and joint ventures to financing, refinancing and restructuring. This involves creating financial models, analytical reports, presentations and designing and implementing a strategic plan. While we have senior lawyers and accountants on our team, we do not directly provide accounting, tax, securities or (typically) legal advice - we maintain a strong network of leading law firms, accountancy firms, tax advisors and securities firms, and are happy to coordinate a unified strategy and manage the work under a single point of contact. Our legal personnel qualified in New York and England maintain their bar registrations and practising certificates for those occasions where we provide non-reserved legal advice in the course of our activities, and Eliot & Luther (UK) Ltd is registered with the Solicitors Regulation Authority with registered number 836263.
